Non-immigrant visas are typically made available only to those who intend to return to their home nation or nation of origin. Immigrant visas are made available to foreign nationals who intend to live and work permanently in the United States.

How do you sponsor a family member for a visa?

Sponsoring a family member for a visa usually involves filing a petition (Form I-130, “Petition for Alien Relative”) with U.S. Citizenship and Immigration Services (USCIS), followed by processing and a visa interview at a U.S. foreign embassy or consulate.

Most visa holders may be accompanied or joined in the U.S. by their spouse and their unmarried children under age 21, who usually qualify for derivative visas. Green card holders may sponsor their spouses and unmarried children under age 21. U.S. citizens may sponsor their spouses, their unmarried children under age 21, their parents, and their siblings.

How do you sponsor a fiancée from abroad?

Sponsoring a fiancée from abroad entails filing Form I-129F, “Petition for Alien Fiancé(e),” with U.S. Citizenship and Immigration Services. It also entails background checks, proving a bona fide relationship, providing evidence of at least two or more meetings within the last two years, and a visa interview at a U.S. foreign embassy or consulate.

A K-1 visa lets a foreign national enter the U.S. to marry a United States citizen within ninety days of entry. The U.S. citizen must file Form I-129F on behalf of the fiancé, and both prospective spouses must meet particular eligibility requirements.

How does a foreign national acquire lawful permanent resident status?

The way that a foreign national can obtain a green card and attain lawful permanent resident status in the U.S. is to be sponsored by either a family member who is already a U.S. citizen or a lawful permanent resident or by a U.S. employer with an open job who has received a labor certification for that job from the United States Department of Labor.

Foreign nationals may also apply for the Diversity Immigrant Visa program, or (when they fear persecution in their home country) seek asylum or refugee status in the U.S.

Can your temporary stay in the U.S. be extended?

Most non-immigrant visa categories allow for extensions, but approval to remain in the U.S. after your visa’s expiration date is not automatic. To extend the time you may remain in the U.S. on a non-immigrant visa, you must apply to USCIS for an extension in advance of your last authorized day in the United States.

For an extension to be approved, you must not have engaged in any criminal conduct in the U.S., and you must not have violated any of the terms or conditions of your non-immigrant visa.

In some cases, an applicant may appeal the rejection of an immigration petition or application. It depends on what immigration benefit you’re seeking and which agency issued the denial. The Administrative Appeals Office (AAO) sometimes reviews the decisions of USCIS officers to promote accuracy in the interpretation of immigration policy and law.

Naturalization is the way a foreign national becomes a U.S. citizen. Typically, to qualify, you need to be a lawful permanent resident for several years. Becoming a citizen, however, doesn’t necessarily require a prior lawful permanent resident status.

To qualify for naturalization, you must be of “good moral character,” pass English literacy, U.S. history, and U.S. government tests, interview with a government official to establish your right to citizenship, and take the Oath of Allegiance to the United States. Some individuals may not be required to take the literacy, history, and government tests.
